US Judge Orders Freedom of Abrego Garcia from ICE Custody

A court has ordered the prompt discharge of Kilmar Abrego Garcia from detention by ICE, finding his ongoing confinement lacks lawful basis.

"Since Abrego Garcia's return from wrongful detention in El Salvador, he has been taken back into custody, again without legal justification," Judge Paula Xinis wrote in her ruling.

The situation stems from a erroneous removal to El Salvador earlier this year, which US authorities later acknowledged was an error. After his repatriation to the United States to answer human smuggling allegations, he was held in federal custody.

In her decision, the judge noted that the authorities does not have a valid removal order, which effectively blocks them from deporting Mr. Abrego Garcia "at this juncture."

The court challenge center on disputed assertions. While the Trump administration contends that Abrego Garcia is a member of the MS-13 criminal organization, he categorically denies this allegation.
